LIMITED 15 YEAR WARRANTY

Warranty
Warming Systems Inc. warrants the Warming Systems mat or cable to be free from defects in material and workmanship for a period of 15 years from the original date of purchase. If you discover a defect in a product covered by this warranty, we will repair at our option using new or refurbished components, or if repair is not possible, replace the item.

Exclusions
This warranty covers defects in the manufacturing discovered while using the product as recommended by the manufacturer. The warranty does not cover improper installation (according to the specifications in the installation manual), loss or theft, nor does coverage extend to damage caused by misuse, abuse, unauthorized modification, improper storage conditions, or mechanical/electrical activities unrelated to the operation of the mat or cable.

Limits of Liability
Should the product(s) fail, your sole recourse shall be repair or replacement, as described in the preceding paragraphs. We will not be held liable to you or any other party for any damages that result from the failure of this product. Damages excluded include, but are not limited to, the following: damages or costs relating to the repair or replacement of the mat or cable, damages the finished flooring incurs while repairing or replacing the mat or cable, lost profits, lost savings, lost data, damage to other equipment, and incidental or consequential damages arising from the use, or inability to use this product. In no event will Warming Systems Inc. be liable for more than the amount of your purchase price, not to exceed the current list price of the product, and excluding tax, shipping and handling charges.

Warming Systems Inc. disclaims any other warranties, express or implied. By installing or using the product, the user accepts all terms described herein.

This Site resides on a server in the USA. You agree that this agreement and your use of this Site are governed by the laws of the USA. You hereby consent to the exclusive jurisdiction and venue of the courts, tribunals, agencies and other dispute resolution organizations in the USA in all disputes (a) arising out of, relating to, or concerning this Site and/or this agreement, (b) in which this Site and/or this agreement is an issue or a material fact, or (c) in which this Site and/or this agreement is referenced in a paper filed in a court, tribunal, agency or other dispute resolution organization. Use of this Site is unauthorized in any jurisdiction that does not give full effect to all provisions of this agreement, including without limitation this paragraph and the warranty disclaimers and liability exclusions above. Warming Systems, Inc. has endeavored to comply with all legal requirements known to it in creating and maintaining this Site, but makes no representation that materials on this Site are appropriate or available for use in any particular jurisdiction. Use of this Site is unauthorized in any jurisdiction where all or any portion of this Site may violate any legal requirements and you agree not to access this Site in any such jurisdiction. You are responsible for compliance with applicable laws. Any use in contravention of this provision or any provision of this agreement is at your own risk and, if any part of this agreement is invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall govern such use.

With the prior agreement of Warming Systems, Inc., any claim, dispute or controversy arising out of, relating to or concerning this Site and/or this agreement shall be decided by binding arbitration in accordance with the Rules of the American Arbitration Association and any such arbitration proceedings shall be brought and held in IL, USA. The decisions of the arbitrators shall be binding and conclusive upon all parties involved and judgment upon any award of the arbitrators may be entered by any court having competent jurisdiction. This provision shall be specifically enforceable in any court of competent jurisdiction.

You agree that Warming Systems, Inc. may at any time and without notice change the terms, conditions and notices under which this Site is offered.

You agree that no joint venture, partnership, employment or agency relationship exists between you and Warming Systems, Inc. as a result of this agreement or your use of this Site.

Warming Systems, Inc.'s performance of this agreement is subject to existing laws and legal process and nothing contained in this agreement is in derogation of Warming Systems, Inc.'s right to comply with law enforcement requests or requirements relating to your use of this Site or information provided to or gathered by Warming Systems, Inc. with respect to such use.

Privacy Policy
Warming Systems, Inc. values your privacy. We will not rent, sell, or otherwise distribute any personal information entered into our website. We will comply with local laws governing requests to access your information only with proper court ordered documents. We hold the right to change this privacy policy at any time and will notify our clients within 30 business days of the change.
